These terms explain subscription access, eligibility, plans, billing, free trials, commissions, add-ons, cancellation, refunds, and platform usage rules for Experts and Establishments.

Overview
These Subscription Terms govern access to and use of the AYKA platform, including its telemedicine services and clinic management SaaS solutions, by registered users including doctors (“Experts”) and clinics (“Establishments”).
By subscribing to AYKA, you agree to these Terms along with all applicable platform policies.
Eligibility
- Experts must be qualified and licensed medical professionals.
- Establishments must be validly registered healthcare entities.
- AYKA reserves the right to verify credentials and approve or reject registrations.
Subscription Plans
Experts Free Plan
- No subscription fee.
- 50% platform commission per consultation/service.
- Basic profile listing and booking access.
Experts Paid Plan
- Subscription fee as per platform pricing.
- 7-day free trial available.
- 20% platform commission per consultation.
- Priority listing, increased visibility, marketing support, and enhanced platform tools.
Establishments Free Plan
- No subscription fee.
- 50% platform commission per booking.
- Basic clinic listing and booking management.
Establishments Paid Plan
- Subscription fee as per platform pricing.
- 7-day free trial available.
- 20% platform commission per booking.
- Priority listing, clinic branding support, patient management SaaS tools, and integration support where applicable.
Free Trial
- A 7-day free trial is available for paid plans.
- Trial begins upon activation.
- After trial expiry, the subscription converts to a paid plan unless cancelled.
- AYKA reserves the right to modify or withdraw the trial.
Fees, GST, and Payments
All fees are exclusive of GST (18%).
- GST is applicable on subscription fees.
- GST is applicable on platform commissions.
- GST is applicable on add-on services.
- Payments are processed through AYKA-approved payment systems.
- AYKA will deduct commission before payouts.
Commission Structure
- Commission applies to all bookings completed through AYKA.
- Free Plan: 50%.
- Paid Plan: 20%.
- AYKA may revise commission with prior notice.
Billing and Renewal
- Subscriptions are billed on a 3-month, 6-month, or 12-month basis, as selected at purchase.
- Subscriptions are auto-renewed unless cancelled before the renewal date.
- Subscription remains valid for the selected duration once activated.
- Subscription cannot be downgraded mid-cycle.
- Users must maintain valid payment details.
- Pricing changes apply from the next billing cycle.
Cancellation and Refund Policy
- Subscriptions may be cancelled at any time.
- AYKA offers a 30-day money-back guarantee subject to policy conditions.
- Refund request must be raised within 7 days of purchase.
- Requests after 7 days are not eligible.
- Refund applies only for first-time subscriptions.
- Approved refunds will be processed within 30 days.
- Access continues until the end of the billing cycle.
- Refund requests must be sent to support@aykacare.in.
Add-On Services
AYKA may offer optional Add-Ons, including:
- Additional users.
- Extra usage units such as consultations or storage.
- WhatsApp AI chatbot and automation tools.
Add-Ons are:
- Charged separately as per platform pricing.
- Exclusive of GST (18%).
- Valid for defined periods.
- Non-transferable and non-refundable.
- Valid only for the subscribed account.
Platform Usage Rules
Users agree to:
- Conduct all transactions through AYKA.
- Not engage in off-platform payments or patient diversion.
- Provide accurate information and pricing.
- Maintain professional standards.
- Violation may result in suspension or termination.
AYKA Rights
- AYKA may modify pricing, commission, or features with prior notice.
- AYKA may suspend or terminate accounts for violations.
- AYKA may update or discontinue services.
Service Disclaimer
- AYKA is a technology platform connecting patients with healthcare providers.
- AYKA does not guarantee patient volume, bookings, or revenue.
- Experts and Establishments are solely responsible for service delivery.
Limitation of Liability
AYKA shall not be liable for:
- Medical outcomes or patient disputes.
- Loss of income, data, or business.
- Indirect or consequential damages.
Indemnity
Users agree to indemnify AYKA against claims arising from:
- Medical negligence.
- Service delivery issues.
- Regulatory non-compliance.
Governing Law and Jurisdiction
These Terms shall be governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts at Saharanpur, Uttar Pradesh.
Updates to Terms
AYKA may update these Terms from time to time. Continued use of the platform constitutes acceptance of the revised Terms.
